Site Assessment / Investigations for Real Estate Property Transactions

Saban's property evaluation process identifies and evaluates recognized environmental conditions, which may result in financial or regulatory liability for owners and lenders or may cause a reduction in collateral value of the real estate. Services include lender and pre-acquisition due diligence, industrial hygiene assessments, subsurface characterization and peer report review and consulting. In all of these areas, Saban continues to evaluate and assist in developing new and improved approaches to conducting environmental due diligence.  Our Services include:

Phase I Environmental Site Assessments (ESAs)

Saban has extensive and strong experience in performing Phase I Environmental Site Assessments (ESAs) that meet, and exceed when necessary, the American Society of Testing Materials (ASTM) Standard E 1527-00, Standard Practice for Environmental Site Assessments: Phase I Environmental Site Assessment Process.  The Phase I ESA process is designed to assist with identification of recognized environmental conditions (RECs).  The primary reason to complete a Phase I ESA is to permit the user to satisfy one of the requirements to qualify for the innocent landowner defense pursuant to the Comprehensive Environmental Response, Compensation and Liability Act (CERCLA).  Saban also has extensive experience with other nationwide clients.  In addition, Saban has been requested by the clients on numerous occasions to modify our scope of work to include the following non-ASTM scope considerations:

ü Preliminary visual screening for asbestos and lead;

ü Cultural resource surveys;

ü Floodplain evaluations;

ü Wetland evaluations;

ü Coastal zone management area impacts;

ü Historic district evaluations;

ü Stormwater evaluations, and

ü Regulatory Compliance evaluations.

Phase II Environmental Site Investigations

Saban assembled for this contract has extensive experience in performing Phase II Environmental Site Investigations (ESIs).  These investigations meet EPA Region I/II and State guidance and practices, and ASTM Phase II criteria.  Saban is experienced with all of the various environmental investigation programs (UST, RCRA, TSCA, CERCLA, voluntary, etc.).

Building Sciences, Engineering & Property Condition Assessments

Saban assembled for this contract has extensive and strong experience in performing Building Sciences, Engineering & Property Condition Assessments (PCAs or BCAs) that meet, and exceed when necessary, the ASTM E-2018-99 “Standard Guide for Property Condition Assessment: Baseline Property Condition Assessment Process”, as well as client protocols and procedures. 

Environmental Assessments to comply with the National Environmental Policy Act (NEPA)

NEPA requires federal agencies to consider and evaluate the potential environmental effects of proposed actions and to integrate those evaluations into the planning and decision-making process.  Our clients are often required to comply with the National Environmental Policy Act of 1969 (42 U.S.C. 4321 et seq.) as implemented by the Council on Environmental Quality Regulations (40 CFR Part 1500-1508) and the NEPA procedures (39 CFR Part 775).
